MoIT proactive and determined in lawmaking and enforcement

The Ministry of Industry and Trade (MoIT) has actively implemented measures to strengthen lawmaking and enforcement, demonstrating a proactive and decisive approach.

A driving force for breakthrough growth

In recent years, especially in 2025, the MoIT’s work in lawmaking and enforcement has achieved important results. Reforms in institutions and policies have been identified as a strong driving force for breakthrough growth.

The legal framework in the industry and trade sector has been continuously improved in all areas, promptly and fully institutionalizing the Party’s guidelines and the State’s policies. These efforts have contributed to improving governance efficiency, ensuring human and citizen rights, and promoting proactive international integration in the process of building and perfecting the socialist rule-of-law state in Vietnam.

According to the Department of Legal Affairs under the MoIT, the ministry’s 2025 lawmaking program has produced positive outcomes, reflecting strong leadership, close direction, and a proactive, responsible working spirit among its departments and units.

As of 30 September, the MoIT had been developing four Laws, two National Assembly Resolutions, 47 Government Decrees, seven Prime Minister Decisions, and 82 Circulars. Among these, the National Assembly has passed two Laws and one Resolution in its 2025 legislative program.

The ministry has submitted 21 draft Decrees to the Government (16 of which have been promulgated) and three draft Decisions to the Prime Minister (all three have been issued). In addition, the MoIT has promulgated 49 Circulars under its authority. For 2026 and the following years, the ministry plans to develop three new Laws, seven Decrees, and nine Circulars.

Notably, the MoIT was the first ministry to complete and submit to the Ministry of Justice the Report on the Review of the Legislative Orientation Program for the 15th National Assembly Term and the Legislative Orientation Plan for the 16th National Assembly Term of the Government, as directed by the Prime Minister. 

The ministry has also been expeditiously drafting two important Decrees: Decree No.139/2025/ND-CP on defining the delegation of authority between two-tier local governments in areas under MoIT’s management, and Decree No.146/2025/ND-CP on decentralization and delegation in the fields of industry and trade.

Strengthening the legal framework to drive development

For the 2026 - 2030 period, the MoIT will continue reviewing and improving the legal and policy framework in the industrial and commercial sectors to create a stronger foundation for development.

According to the Department of Legal Affairs, based on nearly 40 years of reform and the achievements of public administration reform and enhanced national governance during 2021 - 2025, Vietnam’s economy is expected to maintain stable, high-quality, and sustainable growth in the coming years.

Recently, the Politburo issued four key Resolutions, Resolution No.57-NQ/TW, Resolution No.59-NQ/TW, Resolution No.66-NQ/TW, and Resolution No.68-NQ/TW, which serve as four institutional pillars, marking an important milestone in improving the legal system and providing strong momentum for national development in the new era.

The Party and State’s orientations for institution building and legal reform in the industrial and commercial sectors for the 2026 - 2030 period aim to continue perfecting the socialist rule-of-law state in the new stage of development, a period defined by industrialization, modernization, innovation, digital transformation, and sustainable growth.

The MoIT plans to amend and supplement several laws in the industrial and commercial sectors, including the Commercial law 2005, the Law On Foreign Trade Management 2017, the Law on protection of consumers' rights 2023, and the Electricity Law of Vietnam 2024, while reviewing bottlenecks and shortcomings in the implementation of several other laws.

The ministry will focus on reviewing and revising provisions on decentralization, delegation, and division of authority in industry and trade legislation to ensure smooth operation of the two-tier local government model. These efforts aim to enhance the autonomy and creativity of local authorities in socio-economic development, in line with the Party and State’s policy of building a streamlined, efficient, and effective state apparatus.

The MoIT signed Decision No.2449/QD-BCT dated 29 August, 2025, promulgating the Ministry’s Plan to celebrate the “Law Day of the Socialist Republic of Vietnam” in 2025. Accordingly, the MoIT will organize nine activities in response to Law Day, including conferences and seminars on legal affairs, as well as commendation ceremonies honoring collectives and individuals with outstanding achievements in institutional and policy development in the industry and trade sector during the 2021 - 2025 period.
