Broad consensus on the core content of the draft law
Reporting at the session, Deputy Minister of Industry and Trade Nguyen Sinh Nhat Tan stated that the Ministry of Industry and Trade has been assigned by the Government to lead the drafting of the Law on E-Commerce. The draft law has been submitted to the Government, and the Committee on Economic and Financial Affairs has issued a preliminary appraisal report to the National Assembly’s Standing Committee. On September 26, 2025, the Ministry of Industry and Trade submitted a report to the Committee summarizing responses and explanations to appraisal comments.
The drafting process has been conducted in full compliance with regulations, incorporating feedback from all relevant ministries. It closely follows the Government’s orientations and policy guidelines, while clearly structuring the law to define types of e-commerce activities, delineate responsibilities among stakeholders, and address issues related to sustainable e-commerce development. The draft also proposes administrative simplification and maximized digitalization in e-commerce management.

Delegates at the session discussed key aspects such as: the necessity of enacting a Law on E-Commerce; the alignment of the draft with the Party’s policies and guidelines; its constitutionality, legality, and coherence with the broader legal system; as well as its scope, applicability, and rules of implementation, considered the most crucial parts of the draft.
Nguyen Thanh Cong, a member of the Committee on Economic and Financial Affairs, remarked: “The Committee acknowledges that the Ministry of Industry and Trade has revised and clarified the principles governing the relationship between the Law on E-Commerce and other related legal documents. The draft law also specifies the scope of e-commerce activities regulated under the law”.
According to Nguyen Ngoc Bao, Vice Chairman of the Committee on Economic and Financial Affairs, the Committee has cooperated with the drafting agency, the Ministry of Industry and Trade to organize multiple workshops and working sessions on the draft law. Following the Committee’s appraisal report, the National Assembly’s Standing Committee has issued conclusions on the matter.
Nguyen Ngoc Bao emphasized that as of now, the drafting agency (the Ministry of Industry and Trade) and the appraisal agency (the Committee on Economic and Financial Affairs) have reached broad consensus on the main components of the draft Law on E-Commerce, including its content, scope, and policy framework. However, since this is a new law, further review is necessary to ensure its feasibility and compliance with the requirements of competent authorities.
Ministry of Industry and Trade to ensure alignment with related laws
In his response, Deputy Minister Nguyen Sinh Nhat Tan, on behalf of the drafting agency, expressed appreciation for the contributions of National Assembly delegates, associations, and industries, particularly those who supported the Ministry’s explanations and the Government’s report. “During the next phase, the draft law will continue to be refined. The Ministry of Industry and Trade will study and address all relevant comments”, he said, adding: “The Ministry will further review the draft with the utmost openness and ensure comprehensive integration of feedback. We hope the official appraisal report of the Committee on Economic and Financial Affairs will express fundamental agreement with the Ministry of Industry and Trade and the Government, and recommend the National Assembly’s approval at an upcoming session”.

Concluding the session, Phan Van Mai, Chairman of the Committee on Economic and Financial Affairs, requested that the Ministry of Industry and Trade thoroughly consider the appraisal comments and the opinions expressed in the spirit of receptiveness and progress. He also emphasized the need to ensure consistency with related legislation, continue reducing administrative procedures, and take into account new elements such as digital platforms, international practices, and emerging participants, thereby creating a sound legal environment for e-commerce development.
On the afternoon of October 3 in Da Nang City, the 4th plenary session of the National Assembly’s Committee on Economic and Financial Affairs reviewed the draft Law on E-Commerce. At the session, National Assembly delegates and industry representatives generally agreed on the draft’s main contents, while underscoring the importance of continued review to ensure legal coherence, procedural simplification, and enhanced practical feasibility.
