MoIT drafts decree to implement Resolution 253 on energy development

The decree guiding Resolution 253 will clarify mechanisms for updating power planning and developing offshore wind projects for the 2026 - 2035 period.

On the morning of March 11 in Hanoi, the Ministry of Industry and Trade (MoIT) convened a meeting of the drafting committee to develop a decree detailing several provisions and implementation measures for Resolution No. 253/2025/QH15 of the National Assembly on mechanisms and policies for national energy development for the 2026 - 2030 period, with a vision to 2050.

The meeting was chaired by Deputy Minister of Industry and Trade Nguyen Hoang Long and attended by representatives of the Electricity Authority of Vietnam as well as members of the drafting committee from various ministries, agencies and related organizations.

Resolution No. 253/2025/QH15, adopted by the National Assembly at its tenth session, is considered an important document aimed at concretizing major policy orientations of the Party on ensuring national energy security, particularly the directions set out in Resolution No. 70-NQ/TW of the Politburo.

Accordingly, Resolution 253 establishes mechanisms and policies to promote national energy development in a new phase to support the goal of achieving double-digit economic growth. These include policies related to power planning, power grid investment, offshore wind development, direct power purchase agreements (DPPA), investment in the construction of energy projects, and the development of oil, gas and coal infrastructure.

To effectively implement the resolution, the National Assembly has assigned the Government to provide detailed regulations on several key issues, including the adjustment and updating of the national power development plan and the development of offshore wind power projects.

In carrying out this mandate, the Ministry of Industry and Trade has taken the lead in drafting the decree under an expedited procedure in accordance with Decision No. 2835/QD-TTg issued by the Prime Minister, which assigns agencies responsible for drafting legal documents detailing the implementation of laws and resolutions adopted by the National Assembly.

According to the Electricity Authority of Vietnam, the draft decree consists of 12 articles and focuses on four main groups of issues: scope of regulation and applicable entities; contents, components, procedures and processes for adjusting and updating the power development plan; regulations on surveys and the development of offshore wind power; and provisions on implementation and enforcement.

The provisions concerning offshore wind power are regarded as a key component of the decree, aimed at establishing a legal framework to attract and select capable investors to develop offshore wind projects in the coming period.

According to the Electricity Authority of Vietnam, during the drafting process the Ministry of Industry and Trade organized several rounds of consultations to refine the draft decree. Prior to submitting it to the Ministry of Justice for appraisal, the drafting body had received 44 comments from ministries, ministerial-level agencies, local authorities, units under the Ministry of Industry and Trade, as well as relevant corporations and enterprises.

Since the draft was submitted to the Ministry of Justice for appraisal, an additional 10 comments have been received from ministries, agencies, associations and businesses.

According to the drafting body, the regulations must both promote the development of offshore wind power and ensure that enterprises with adequate capacity, experience and financial resources are selected to develop large-scale offshore wind projects.

This orientation is also consistent with the Party and State’s policy of assigning reputable and capable enterprises to undertake large-scale energy projects while ensuring national defense, security, and maritime sovereignty.

The authority to approve investment policies for offshore wind power projects has already been clearly stipulated in Resolution No. 253/2025/QH15. According to the Ministry of Industry and Trade, the drafting committee will continue reviewing and incorporating constructive feedback to finalize the draft decree before submitting it to the Government for consideration and issuance.

The early completion of the decree is expected to help establish a comprehensive legal framework to promote national energy development, including offshore wind power projects, a sector widely considered to hold significant development potential in the coming years.
