Digitization of land administration a necessity: Deputy PM

(VEN) - It is necessary to digitize land administration in order to establish an effective governance system, address fundamental shortcomings in land management, and reduce inconvenience and hassle faced by the people, organizations and enterprises, said Deputy Prime Minister Tran Hong Ha at a recent meeting on the draft decree governing basic land investigation, land and land-based property use right certificates, and land information.

Deputy Prime Minister Tran Hong Ha said the decree mentions the rights and interests of citizens, organizations and enterprises, so it needs to provide neat, clear, transparent and simplified regulations. The State is in charge of granting land and land-based property use right certificates.

Plots of land with transparent information and clear boundaries are legally protected by the State, Ha said. He suggested some solutions to handle unregistered land plots, such as further simplifying procedures; fee reductions and exemptions, and allowing land users to owe fees; and issuance of regulations on transaction of land plots without legal certificates.The Deputy PM said it is necessary to clarify the power and responsibility of local governments in basic land investigation, land and land-based property use right certificate issuance, and land information. Land advisory, investigation and survey agencies must meet the material premise and manpower standards.

The draft decree must closely be compliant with the Land Law to help quickly build transparent, neat digital land databases, Ha said. He told the Ministry of Natural Resources and Environment to gather proposals and get experts’ opinions to urgently finalize the draft decree in June. A goal is for an adequate, neat, transparent and efficient decree to be ratified and issued to increase the comfort of the people, enterprises and management agencies.

According to a report by the Ministry of Natural Resources and Environment, the draft decree consists of five chapters with 68 articles, detailing 11 contents stated in the Land Law.

Mai Van Phan, Director of the Department of Land Registration and Information Data under the Ministry of Natural Resources and Environment, said the draft decree has some new policies - principles of surveying, establishing and using cadastral maps; responsibilities and authorities to organize basic land surveys with specific indicators, and build databases; and requirements to register land information; among others.

Assoc. Prof., Dr. Le Thanh Khuyen from the Vietnam Soil Science Association said the procedures for registering land use right changes associated with land transactions need to be simplified, as all information about land plots and related assets has been integrated into land use right certificates.

A representative of the Vietnam Chamber of Commerce and Industry (VCCI) suggested that the decree stipulate land survey, assessment and inspection experts must be those who have directly participated in at least one national and three provincial-level land assessment projects.

Representatives from the people’s committees of Ha Tinh, Long An and Quang Nam provinces gave suggestions on the simplification of administrative procedures in land and land-based property use right certificate issuance; building and updating land databases at the local level; clarification of responsibilities for land plot measurement upon changes; and supplementing forms and methods for measuring land plots for residential area, industrial park and industrial cluster development projects.
